1. Introduction & Acceptance

Welcome to K-Gallery. This website is operated by K-Gallery, located at 2100 E Valencia Dr # B, Fullerton, CA 92831. By accessing or using k-gallery.com (the "Site"), you agree to be bound by these Terms of Service ("Terms"), all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws.

If you do not agree with any of these Terms, you are prohibited from using or accessing the Site. These Terms apply to all visitors, users, customers, contributors, authors, and anyone who accesses the Site.

Accounts on K-Gallery are created through Shopify Customer Account login. By creating an account, you agree to the following:

  • You must provide accurate, current, and complete information during the registration process and keep your account information up to date.
  • You are responsible for safeguarding your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.
  • User roles determine your permissions on the Site: contributors may submit posts for editorial review, authors may publish content directly, and administrators have full access to site management features.
  • We reserve the right to suspend, disable, or terminate your account at our sole discretion, without prior notice, for conduct that we determine violates these Terms, is harmful to other users or the Site, or for any other reason.

3. User-Generated Content

K-Gallery allows users to create, post, and share content including blog posts, comments, and other materials ("User Content"). By submitting User Content, you agree to the following:

  • You retain full ownership of your User Content. However, by posting content on the Site, you grant K-Gallery a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, display, distribute, and promote your User Content in connection with the Site and K-Gallery's business, including on social media and marketing materials.
  • All User Content is subject to automated moderation using artificial intelligence technology and may also be subject to manual review by our team. We reserve the right to remove, edit, or refuse to publish any content that violates these Terms, community guidelines, or is otherwise deemed inappropriate at our sole discretion.
  • You represent and warrant that your User Content does not infringe upon or violate the intellectual property rights, privacy rights, publicity rights, or any other rights of any third party.
  • You are solely responsible for your User Content and any consequences of posting or publishing it. K-Gallery does not endorse any User Content or any opinion, recommendation, or advice expressed therein.

4. E-Commerce & Shop

K-Gallery offers products for purchase through our integrated Shopify storefront. The following terms apply to all purchases:

  • All prices are listed in United States Dollars (USD) and are subject to change without prior notice. Prices do not include applicable taxes or shipping costs unless otherwise stated.
  • We make every reasonable effort to display product colors, images, and descriptions as accurately as possible. However, we cannot guarantee that your device's display will accurately reflect the actual colors and details of the products.
  • We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or product information, or suspected fraudulent activity.
  • Payment is processed securely through Shopify's payment infrastructure. K-Gallery does not store your payment card details.
  • For information on returns and refunds, please refer to our Return Policy. Shipping policies and estimated delivery timelines are provided as estimates and are not guaranteed.

5. AI Features Disclaimer

K-Gallery offers AI-powered features, including skin analysis powered by OpenAI technology. By using these features, you acknowledge and agree to the following:

  • All AI-generated results, recommendations, and analyses are provided for informational and entertainment purposes only. They do not constitute medical advice, diagnosis, or treatment.
  • You should always consult a qualified healthcare professional or dermatologist for any skin concerns, conditions, or before making changes to your skincare routine based on AI-generated recommendations.
  • K-Gallery makes no warranties or representations regarding the accuracy, completeness, or reliability of AI-generated content, recommendations, or analyses. Results may vary and are not guaranteed.
  • Product recommendations generated by AI features are algorithmically produced and do not constitute professional endorsements, medical recommendations, or guarantees of effectiveness.

6. Intellectual Property

All content, features, and functionality of the Site, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, software, and the overall design and arrangement thereof, are the exclusive property of K-Gallery or its content suppliers and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any material from the Site without the prior written consent of K-Gallery, except for your personal, non-commercial use. User-generated content remains the property of the original creator, subject to the license granted in Section 3.

  • YouTube video embeds on the Site are subject to YouTube's Terms of Service and Google's Privacy Policy.

The Site and all content, products, and services provided through the Site are offered on an "as is" and "as available" basis without any warranties of any kind, either express or implied.

K-Gallery does not warrant that the Site will be uninterrupted, timely, secure, or error-free, that defects will be corrected, or that the Site or the servers that make it available are free of viruses or other harmful components.

K-Gallery does not warrant or make any representations regarding the accuracy, reliability, or completeness of any user-generated content on the Site. Any reliance you place on such content is strictly at your own risk.

10. Limitation of Liability

To the maximum extent permitted by applicable law, K-Gallery, its officers, directors, employees, agents, affiliates, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of (or inability to access or use) the Site.
  • Any conduct or content of any third party on the Site.
  • Any content obtained from the Site.

In no event shall K-Gallery's total aggregate liability to you for all claims arising out of or relating to the use of the Site exceed the total amount paid by you to K-Gallery during the twelve (12) months immediately preceding the event giving rise to the claim. These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the state and federal courts located in Orange County, California, for the resolution of any disputes arising out of or relating to these Terms or the Site.

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other provision of these Terms, and the remaining provisions shall continue in full force and effect.
